Did negligent security contribute to the shooting death at a Phenix City apartment complex and are justice and compensation available to the victim’s family?

LOCAL NEWS

Gunfire erupted at a Phenix City, Alabama apartment complex Sunday, May 12, 2019, leaving one man dead.  According to Ledger-Enquirer.com, “[o]fficers were called at 9:50 a.m. to a report of shots fired at Greenleaf Apartments, 1701 37th St., where they found a man shot to death in his vehicle.”  WRBL.com is reporting, “the victim and another male were involved in an altercation before the shooting…[t]he male who was involved in the incident was not on scene.”  Police are searching for that suspect.

OUR LEGAL TAKE

Apartment residents and guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided at the apartment complex and whether this shooting may have been prevented.

  • What security measures were in place to deter crime and protect the victim at the time of the shooting?
  • Have there been prior incidents of violence on the property?
  • Was the suspect a resident of the apartment complex?
  • How was the suspect able to gain access to the property?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner failed to provide adequate security to protect those on its premises, the victim’s family may seek justice and elect to pursue legal claims for their loss.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
