A shooting at the Robles Park Village apartments reportedly left 21-month-old Aaliyah Avila injured Wednesday afternoon, November 16, 2016.
According to Tampa Bay Times, “more than 15 shots were fired at a home in the Robles Park Village public housing complex Wednesday, striking a toddler girl in the leg.” The young girl’s father, Eduardo Avila, was apparently “approached by multiple men who were behaving in a threatening manner” outside his apartment home. “When [Mr.] Avila went inside, the men began shooting at the door.” His little girl was struck in the hail of gunfire.
Police have not yet identified the suspects. One neighbor told The Tampa Bay Times, “There’s constantly shooting around here….A lot of residents fear for their safety here, so they hate to call the police or go to the front office because they’re fearful of retaliation against them.”
Our Legal Take
Apartment residents and guests have a right to feel safe and secure within the community. The Murray Law Firm questions the level of security provided at the apartment complex and whether the unconscionable shooting of this innocent child may have been prevented.
- How did the gunmen gain access to the property? What security measures, such as gated-entry, security patrols and surveillance cameras, were in place to deter crime at the time of the shooting?
- Were any additional security precautions implemented by the property owner or management to protect residents, following Tampa Bay Times reports of prior gun violence?
Generally, property owners are required to protect all residents and guests legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner or management company failed to provide adequate security to protect those on its premises, the family of young Aaliyah Avila may seek justice and elect to pursue a legal claim for her injuries.
Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
