Did a security failure contribute to the deaths of April Lynn Holland and Dwayne Garvey? Two Shot at America’s Best Value Inn, Raleigh

Local News

A shooting inside America’s Best Value Inn reportedly claimed the lives of 22-year-old April Lynn Holland and 27-year-old Dwayne Garvey Friday morning, December 2, 2016.

According to WNCN News, the fatal shooting occurred “just before 5 a.m. at the America’s Best Value Inn, located at 3921 Arrow Drive.”  Someone inside the hotel apparently called 911 to report “gunshots out in the hallway.” Emergency responders discovered Ms. Holland and Mr. Garvey with fatal injuries at the scene.

Our Legal Take

Hotel guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided in the hotel and whether this tragedy may have been prevented.

  • What security measures, such as security patrols, guest screening and surveillance cameras, were in place to deter crime at the time of the shooting?
  • Have there been prior incidents of violence on or near property? If so, were any additional security precautions implemented by the hotel owner or management to protect guests?

Generally, property owners are required to protect all guests legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the hotel owner or management failed to provide adequate security to protect those on its premises, the families of Ms. Holland and Mr. Garvey may seek justice and elect to pursue legal claims for their wrongful deaths.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victims’ families retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
