Negligent Security? Our Legal Take: Fatal Virginia Beach Nightclub Shooting

Did negligent security contribute to this fatal nightclub shooting? Read Our Legal Take to find out if the victim’s family may have a legal avenue for justice and claims for compensation.

Local News

A shooting at Club Embassy, in Virginia Beach, reportedly claimed the life of 34-year-old Demetrius McCloud Monday, August 29, 2016.

According to WAVY 10 News, “Officers responded to Club Embassy in the 5400 block of Virginia Beach Boulevard around 1:35 a.m. after dispatchers received a call about a victim with a gunshot wound.”

Mr. McCloud was apparently shot “during a party” at the nightclub per the CBS 19 report. The news outlet further reports that “[t]he shooting early Saturday was at least the fourth at the Club Embassy nightclub in the past two years.”

Our Legal Take

Nightclub patrons have a right to feel safe and secure on the property that they are visiting. Given the reported history of gun violence, as chronicled by CBS 19, The Murray Law Firm questions the level of security provided at the nightclub and whether this shooting may have been prevented.

  • What nightclub security measures, such as weapons screenings, bright lighting, security patrols, and surveillance cameras, were in place to protect patrons at the time of the shooting?
  • Was ownership or management aware of prior incidents of violence on or near property? If so, were any additional security measures implemented to deter crime?

Generally, property owners are required to protect all patrons legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the owner or management of the establishment failed to provide adequate security to protect those on its premises, the family of Mr. McCloud may seek justice and elect to pursue a legal claim for his wrongful death.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victim’s family retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
