Could the tragic loss of this young woman have been prevented?

Local News

Gunfire reportedly broke out at a Fort Wayne, Indiana Sunoco gas station Sunday morning, January 14, 2018, claiming the life of 21-year-old Destinie Haywood and leaving 16-year-old Tieranie Giddens and 25-year-old Keon Oakley Jr. injured.

According to The Journal Gazette, the victims were “parked at a gas station pump near a fence” at the “Sunoco gas station and MyMarket convenience store” when they were “ambushed.” WPTA 21 reports, Miss Giddens and Mr. Oakley were both transported to the hospital in “serious condition.” Tragically, Ms. Haywood succumbed to fatal injuries at the hospital.

Our Legal Take

Gas station patrons have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided on the property and whether this tragedy may have been prevented.

  • Have there been prior incidents of violence on or near property? What security measures, such as bright lighting, surveillance cameras and security patrols, were in place at the time of the shooting?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the gas station owner failed to provide adequate security to protect those on its premises, the family of Destinie Haywood may seek justice and elect to pursue legal claims for her wrongful death. Additionally, Tieranie Giddens and Keon Oakley Jr. may elect to pursue legal claims for their injuries.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victims retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
