FORMER CLIENT: I had lawyers calling me, and friends telling me who I should hire…I trusted in The Murray Law Firm and I’m glad I did.

Parking lot patrons have a right to feel safe and secure while on the premises they are visiting. The level of security provided at the property is of significance, and is a relevant consideration when analyzing whether this shooting may have been prevented.  The following questions are also important in assessing whether this incident may have been avoided:

  • Have prior incidents of violence been reported on or near the property, and, if so, were any security measures added after any prior incidents?
  • Did the property have adequate security in place at the time of the shooting?
  • What security measures, such as visible surveillance cameras, and security personnel, were in place to deter crime and protect the victim at the time of the shooting?

Property owners are generally required to protect against foreseeable harm to anyone and everyone legally on the premises.  Should the investigation into this incident reveal facts that establish that the property owner or management lacked adequate security to protect its visitors, the family of Darea Owens may seek justice and elect to pursue legal claims and substantial compensation for their loss.

The Murray Law Firm has extensive and successful experience in handling security negligence claims on behalf of victims and their families, and suggests that an immediate, unbiased inspection of the property will need to be performed so as to limit evidence from being altered, damaged or destroyed.  The complexities of pursuing a negligent security case are well understood by the legal team at The Murray Law Firm, and it is imperative that the family of Darea Owens retain a capable law firm who will work without delay to protect their interests.

Did a Fatal Security Lapse Contribute to This Deadly Phoenix Shooting?

Our Legal Take

Parking lot and apartment complex guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided on the property where this shooting took place and whether this tragedy may have been prevented.

  • How did the gunmen gain access to the property? What security measures, such as bright lighting, security patrols, and surveillance cameras, were in place to deter crime at the time of the shooting?
  • Have there been prior incidents of violence on or near property? If so, were any additional security precautions implemented by the property owner and management to protect guests?

Generally, property owners are required to protect all patrons legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the owner or management of the parking lot failed to provide adequate security to protect those on its premises, the family of Jennifer Perez may seek justice and elect to pursue legal claims for her wrongful death. Additionally, the other victim of this shooting may elect to pursue legal claims for his injuries.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victims retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
