Did negligent security contribute to the tragic loss of a 4-year-old girl and a young father?

Local News

Gunfire erupted at the Westward Square apartment complex in Houston Sunday night, October 15, 2017, tragically claiming the lives of 4-year-old Ashley Perdomo and 31-year-old Miguel Marquez.

According to The Houston Chronicle, shots were fired in “a breezeway of the Westward Square Apartments, in the 6200 block of Gulfton,” shortly after 10:30 p.m. 30-year-old Zibulla Sahok was also injured in the shooting according to the report.

HPD Spokesman Victor Senties told media the department has received “‘literally dozens of calls’ about the complex in the past six months,” raising grave questions over apartment security and resident safety.

Our Legal Take

Apartment residents have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided on the property and whether this tragedy may have been prevented.

  • What security measures, such as bright lighting, gated-entry, surveillance cameras, and security patrols, were in place to protect residents and guests and deter crime at the time of the shooting?
  • Were any additional security measures implemented by the apartment complex owner or management following media reports of prior crime on property?

Generally, property owners are required to protect all those legally on the premises from any foreseeable harm. Should the facts of this matter reveal that the apartment complex owner failed to provide adequate security to protect those on its premises, the families of Ashley Perdomo and Miguel Marquez may seek justice and elect to pursue legal claims for their wrongful deaths. Additionally, Carol Perdomo and Zibullah Sahok may pursue claims for their injuries.

Based upon its prior successful experience in handling security negligence claims on behalf of victims and their families, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed. Given the complexities of pursuing a negligent security case, it is imperative that the victims retain an experienced attorney who can ensure the preservation of any and all evidence that may support such a claim.
